1. Purpose

Banks Sails designs and builds sails to exacting standards. Every product is the result of advanced materials, proven engineering and skilled craftsmanship. This Limited Warranty defines our obligations to you, the original owner, in the unlikely event that a manufacturing defect occurs.

2. Warranty Coverage

Banks Sails warrants to the original purchaser that each new sail is free from defects in materials and workmanship under normal and intended use for a period of twenty-four (24) months from the date of delivery.

Covered defects include:

Seam or stitching failures caused by workmanship.
Panel delamination or bonding separation due to manufacturing faults.
Hardware failures (clew rings, headboards, luff slides, batten pockets, etc.) resulting from production defects.
Premature material failure under conditions consistent with the sail’s intended design purpose.

3. Exclusions

This Limited Warranty does not cover:

Normal wear and tear, UV degradation, mildew, or chafe.
Damage caused by misuse, neglect, improper handling or inadequate maintenance.
Damage caused by rigging errors, collisions, grounding, flogging or weather conditions beyond the sail’s rated limits.
Sails modified, altered or repaired by anyone other than an authorized Banks Sails loft.
Sails used in a manner materially inconsistent with their intended specification or rating.

4. Warranty Claims

Notification – Contact your local Banks Sails loft or authorized dealer within the warranty period. Provide proof of purchase, a description of the issue and photographs where possible.

Inspection – The sail must be returned (shipping prepaid) to an authorized Banks Sails location for inspection and assessment.

Resolution – If a defect is confirmed, Banks Sails will, at its sole discretion, repair or replace the sail. Return shipping of the repaired or replacement sail will be arranged as agreed between the parties.

Warranty Duration – Any repair or replacement does not extend or restart the original warranty period.

5. Limitations of Liability

Banks Sails’ liability under this warranty is limited exclusively to repair or replacement of the defective sail. Banks Sails shall not be liable for any indirect, consequential, or incidental damages including, but not limited to, loss of use, downtime, charter income or haul-out costs.

This limitation reflects standard practice within the marine industry and acknowledges the demanding realities of sail use at sea.

6. Transferability

This warranty applies only to the original purchaser and is non-transferable without the prior written consent of Banks Sails.

7. Governing Law

This warranty shall be governed by and construed according to the laws of the country in which the sail was purchased and delivered. Any claim under this warranty must be initiated within the warranty period or within one year of the defect’s discovery, whichever occurs first.

8. Our Commitment
